These Terms and Conditions (“these Terms”) govern your use of the website http://www.justlodgeholidays.com (the “Site”) and your relationship with Bruton Solutions Limited (BSL). For your own benefit and protection you should read these Terms carefully before Registering. If you do not agree to the Terms, please do not register for or use the Site.
This Agreement is personal between you and BSL and does not create any right enforceable by any other person. By using the Site you agree to be bound by these Terms.
1. USE OF THE SITE
1.1 As a registered member your access to the Site is limited and restricted to placing on the Site a description (including photographs and text in which you own or have rights to use the copyright) of your property as permitted by these Terms (“the Property Information”) and amending the property information from time to time. The property described must be a Unit (that is, a Lodge or Log Cabin - (see paragraph 1.4 below)
1.2 You will not use the Site for any purpose likely to give rise to improper or unlawful behaviour including but not limited to:
(a) posting abusive, obscene, or otherwise objectionable material or otherwise which breaches applicable laws, regulations or codes of practice;
(b) interfering with any other person’s use or enjoyment of the Site; and/or
(c) Posting, uploading, emailing or otherwise transmitting any material designed to interrupt, restrict, destroy, limit the functionality of or compromise the integrity of any computer software, hardware or telecommunications equipment.
(d) adding any link to any third party website or third party email address in any property information. You may only add a link to your own website and email address.
1.3 You acknowledge that BSL may, in its sole discretion, take appropriate action against any person it suspects to be engaging in any unlawful activity or otherwise violating these Terms of this Agreement, but is under no obligation to do so.
1.4 You must ensure that:
(a) the information contained in the property information is accurate and not misleading in any way.
(b) property information is restricted to one (1) Unit for which it is registered. In the case of multiple Units you must not register more than 5 separate single Units belonging to you under the same registration;
(c) the property information exclusively relates to a Unit; that is, Lodges or Log Cabins. It is strictly prohibited for property information to relate to: Apartments, Bed and Breakfasts, Bungalows, Caravans, Cottages, Houses, Hotels and Sea-Side Chalets.
2. AMENDMENTS
2.1 BSL may update these Terms from time to time for legal or regulatory reasons or to allow the proper operation of the Site. Continued use of the Site indicates your agreement to be bound by any new terms.
2.2 BSL does not guarantee the availability or functionality of the Site will be uninterrupted, error free, or that the Site or the server that makes it available are free of viruses or anything else, which may be harmful or destructive. If a fault occurs please report it to info@brutonsolutions.co.uk.
2.3 Your access to the Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. BSL shall not be liable to you for any change or removal.
2.4 BSL reserve the right to modify, amend or remove property information in its absolute discretion for any reason including a breach of these Terms or if BSL receive a significant number of substantiated complaints with regards to misrepresentation of the Unit and its surroundings. Where this happens there will be no refund in full or part of the Membership Fee.
3. MEMBERSHIP AND MEMBERSHIP FEE
3.1 In order to become a member you must register your details with the Site and pay a membership fee of £99.00 (the “Membership Fee”) for a period of 12 months.
3.2 Once you are a member you will be able register one Unit as provided in paragraph 4 below.
3.3 To register as a member on the Site you must: (a) be over eighteen years of age; (b) have a valid Pay-Pal account (“www.pay-pal.com”) and (c) provide your current full legal name, email address and current permanent residential address (“Personal Information”) along with any other information BSL request.
3.4 Your personal information will only be used by BSL for security and/ or privacy purposes to protect your interests and will only be used subject to your consent for any access, promotion event or the like facilitated by or associated with the Site.
3.5 You may also pay the Membership Fee in accordance with paragraph 4.2, below.
3.6 For those members who have opted to pay offline, you will receive a renewal invoice at the end of the 12 month term at least one month prior to the renewal date. You must notify BSL at least seven days prior to the renewal date if you do not wish to renew. Failure to provide the correct notice will indicate to BSL that you wish to renew. The full amount of the renewal invoice will then be due. There will be no deviation of the full amount being due if you have forgotten to cancel your renewal within the one month’s notice given, or that you have changed your mind regarding retaining membership after the renewal date.
4. REGISTRATION OF PROPERTY INFORMATION
4.1 Having paid the Membership Fee, you will be entitled during the period covered by your Membership Fee to upload:
(a) 1 Unit, for free; and
(b) up to 4 additional Units at a fee of £40 + VAT for each such additional Unit.
4.2 The Membership Fee is payable via Pay-Pal, BACS, or cheque to Bruton Solutions Ltd
5. PASSWORD AND SECURITY
5.1 On registering you will be asked to create a username and password. You must not allow any third party to use your username or password to access the Site.
5.2 If BSL reasonably believes that there has been a breach of security or misuse of the Site BSL may, at its sole discretion, suspend or terminate your membership and/or any registrations.
6. CANCELLATION OR SUSPENSION
6.1 BSL reserves the right to suspend or cancel your membership and/ or registration/s, if it reasonably believes that you have breached any of the obligations under these Terms. Such suspension shall not affect either party’s statutory rights or liabilities.
6.2 You can cancel your membership and/ or registration at any time by informing BSL in writing at info@brutonsolutions.co.uk.
7. NO REFUNDS
7.1 BSL will not issue any refunds for loss of profit, membership fees and/or registrations nor any other costs associated with the amendment or removal of property information in breach of these Terms; nor in the event that your membership is suspended or cancelled by BSL in accordance with these Terms or should you decide to cancel your membership and/ or any registrations.
8. INTELLECTUAL PROPERTY
8.1 When posting material on the Site you make the following warranties and representations: (a) that you own the copyright in the photographs and text supplied to the Site; or (b) that the owner of the copyright has granted you authority to post the property information.
8.2 In posting property information you grant and will procure in favour of BSL a perpetual, royalty-free licence to use the property information for promotional purposes (including marketing and public relations). You irrevocably and unconditionally agree to indemnify BSL for any cost, loss or liability (including legal costs) incurred for any breach of copyright arising from the use of the property information.
8.3 Apart from your own property information, you may not reproduce photographic or text from any part of the Site without the express written permission of the copyright owner.
9. DISCLAIMERS AND LIMITATION OF LIABILITY
9.1 BSL will under no circumstances be held liable for damages to you nor any other person arising out of or in connection with the use of the Site including but not limited to: loss of revenue or anticipated profits; loss of data; loss of business; loss of opportunity; loss of goodwill; injury to reputation; losses suffered by third parties; and any indirect, consequential, special or exemplary damages.
10. SEVERABILITY
10.1 If any part of these Terms are determined in law to be invalid, void or unenforceable for whatever reason, the remaining provisions not so declared shall nevertheless continue in full force and effect without being impaired in any manner whatsoever.
11. THIRD PARTY WEBSITES
11.1 The Site includes links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that BSL is not responsible for the content or availability of any such sites.
11.2 BSL at its sole discretion reserves the right to remove email addresses and links to external websites which BSL consider inappropriate, or that act against the interests of BSL.
12. JURISDICTION
12.1 This agreement is subject to the laws of England and Wales, and you agree to submit to the exclusive jurisdiction of the courts of England and Wales.
13. FORCE MAJEURE
13.1 BSL shall not be liable for any default due to any act of God, or other event beyond its control.
14. HEADINGS
14.1 The headings within this Agreement are inserted for clarification only and are not to be used for the purposes of interpretation.
